Defence against drug offence allegations
Society’s war against drugs has resulted in a wide range of offences aimed at tackling every stage of the drug supply chain, from personal use to intentions to production, and for every type of drug, from cannabis to heroin. A majority of these offences are found in the Misuse of Drugs Act 1971, such as unlawful possession, possession with intent to supply, offering to supply and allowing premises occupied or managed to be used unlawfully for the purpose of producing or supplying.
The penalties following a successful prosecution of these and other drug-related offences vary according to their seriousness. For example, active involvement in a supply chain that seeks to profit from other people’s use will attract much more severe consequences than a minor possession offence. The penalty also depends on the class of drug. For example, class A drugs such as heroin, ecstasy, LSD, methamphetamine, methadone and cocaine will attract a harsher penalty than for class B (such as cannabis, ketamine and amphetamines) or class C (such as Valium or another form of benzodiazepines).
